This Service Agreement outlines the terms, expectations, and responsibilities for both pHX Pool Pros Service & Repair and the homeowner. Please review the details below and let us know if you have any questions.

1. Service Agreement Overview

The customer is contracting pHX Pool Pros Service & Repair to perform recurring pool and/or spa maintenance at the service address provided.

This is a month-to-month service agreement, billed in advance. Service begins once the first month’s payment is received.

pHX Pool Pros Service & Repair bills for weekly service on a monthly basis in advance. Payment is due on the 1st of each month and covers that month’s scheduled services. New customers will be prorated based on their start date. A valid card on file is required for all recurring services. Services are subject to be paused or canceled due to non-payment until the account is brought current.

2. Service Frequency & Fees

Weekly service includes:

  • Water testing & chemical balancing
  • Basic required chemicals included
  • Skimming, brushing, and basic vacuuming as needed. *Requires a functioning in-floor or suction-side cleaner; extra charges may apply if additional vacuuming is required.
  • Emptying filter and skimmer baskets
  • Equipment checks
  • Digital service reports with photos

Monthly service fees are agreed upon at signup and billed in advance.

Payment Terms

Payment for recurring pool service is due on the 1st of each month and covers services scheduled for that month.

pHX Pool Pros Service & Repair understands that occasional circumstances may arise and will extend a grace period of up to seven (7) days, provided there is clear communication from the customer regarding the delay.

If payment is not received within seven (7) days of the due date, a $15 late payment fee will be applied to the account.

pHX Pool Pros Service & Repair reserves the right to pause or cancel services if payment is not received within the grace period or if no communication has been made. Service may resume once the outstanding balance, including any applicable fees, has been paid in full.

Disclaimer

Credit Card Surcharge Policy

Payment Methods & Surcharge Notice

pHX Pool Pros Service & Repair accepts multiple forms of payment including credit/debit cards, ACH, and other approved methods.

To help offset rising processing costs, a 3% surcharge will be applied to all credit card payments. This fee is not applied to debit card or ACH payments.

Customers may avoid this fee by choosing an alternative payment method such as ACH or other approved options.

By submitting payment via credit card, the customer acknowledges and agrees to this surcharge.

Rate Adjustment Policy

While it is our intention to maintain your current monthly service rate, adjustments may become necessary due to changes in service requirements, chemical costs, or overall operating expenses. Any potential rate increase will always be communicated and discussed with you in advance, and no changes will be made without prior notice.

3. Weather Conditions

Service may be modified during:

  • High winds
  • Heavy rain
  • Monsoon conditions
  • Extreme temperatures

If weather conditions impact your scheduled service, we will perform services to the extent conditions safely allow, including adding necessary chemicals. We typically work through light rain; however, if conditions worsen or there is lightning nearby, service will be paused and resumed the following week.

During monsoon season, pools often require additional time due to debris and environmental conditions. We will make reasonable efforts to service the pool; however, heavier cleanups may require additional service.

Any additional work beyond normal service—including storm cleanup, excessive debris removal, or abnormal conditions—will be discussed and approved prior to being performed.

4. Pool Area Access

The customer agrees to provide safe, unobstructed access to the pool area on the scheduled service day. Locked gates, aggressive pets, or blocked access may prevent service from being completed.

No credit or refund will be issued if pHX Pool Pros Service & Repair is unable to perform service due to any of the above conditions or other access limitations beyond our control.

5. Vacation & Holiday Schedule

Service may be suspended for up to two (2) weeks at the Company’s discretion, as well as during the weeks of Thanksgiving and Christmas.

No service credits will be issued for these scheduled closures, as they are included and accounted for in the agreed monthly service rate. The Client will be notified in advance of any planned service interruptions.

6. Additional Services & Repairs

pHX Pool Pros Service & Repair provides repair services and can coordinate specialty work through trusted partners.

Additional charges may apply for:

  • Equipment repairs or replacements
  • Specialty chemicals
  • Green-to-clean treatments
  • Filter cleanings
  • Major system diagnostics

No repair work will be performed without customer approval.

7. Additional Maintenance Services

To help maintain optimal water quality and equipment performance, the following periodic services are recommended. These services are important and may be performed as needed based on your pool’s condition:

  • Filter Deep Cleaning: $100 (recommended every 4 months)
  • Pool Draining & Startup Chemicals: Approximately $350-$400 (recommended every 2 years)

Failure to maintain regular filter cleanings may result in reduced system efficiency, poor water clarity, and potential equipment damage, which may require additional service and cost. Service frequency may vary depending on pool usage, environmental conditions, water quality, and equipment performance. Any additional services or charges will always be discussed and approved prior to being performed.

8. Termination Policy

Either party may terminate this agreement by providing a minimum of thirty (30) days’ written notice.

If services have been prepaid, pHX Pool Pros Service & Repair will continue to perform scheduled services through the end of the paid service period.

Any outstanding balances must be settled prior to termination.

If, upon mutual agreement, services are not completed through the end of the prepaid period, a prorated credit may be issued for any services not performed.

9. Liability & Equipment Condition

pHX Pool Pros Service & Repair is not responsible for any damage to property or equipment resulting from acts of nature, fire, vandalism, misuse, or neglect.

The Client acknowledges that normal wear and deterioration of pool equipment and surfaces will occur over time due to exposure to chemicals, sunlight, and other environmental factors.

The Client is responsible for any damage or deterioration resulting from failure to follow recommended services or from not properly maintaining the pool between scheduled visits.

pHX Pool Pros Service & Repair shall not be held liable for the natural deterioration of pool surfaces or equipment due to age, chemical use, or standard operating conditions.

10. Acceptance of Terms & Signature

By filling out and submitting the form below, you acknowledge that you have read, understand, and agree to the terms and conditions outlined in the pHX Pool Pros Service & Repair Agreement.
